North Lancashire Conduct Complaint

Lancashire Care Association has asked the CCP to assess whether North Lancashire (as lead commissioner for 24 Primary Care Trusts in the North West Strategic Health Authority) has acted inconsistently with the Principles and Rules for Cooperation and Competition. Lancashire Care Association has alleged that North Lancashire (as the lead commissioner) has failed to act consistently with Principles 2 and 3 when setting the fee level for a procurement that is being run for continuing health care in each of the 24 PCT areas.

The CCP is assessing this issue under the conduct provisions of the Principles and Rules for Cooperation and Competition and will decide whether the conduct of North Lancashire PCT is likely to give rise to an adverse effect on patients or taxpayers.

The CCP would welcome submissions from interested individuals and organisations on any matter relevant to the CCP’s assessment of this case under the Principles and Rules for Cooperation and Competition. To submit evidence please use the email address: cases@ccpanel.gsi.gov.uk.

The closing date for initial submissions is 20 June 2011.

* At the end of Phase I, the CCP will either:

  • advise that the conduct in question is consistent with the Principles and Rules for Cooperation and Competition; or
  • proceed to a more detailed Phase II investigation.

** Phase II allows the CCP to undertake a more in-depth investigation where this is required to fully assess the matter.
